I have been separated now for over five years. I now want to apply for a divorce?

We separated and sold our house I bought another house for a sum of money and my husband took the remainder of the money. We did not draw up any agreement regarding splitting the money and came to an understanding that I would have a home and he would take the remainder of the money we were not on bad terms. My new house is in my name and I am working supporting myself. I have been advised to obtain a Financial Consent Order so I wont claim on his pension and he wont claim on any of my finances, there are no children involved. I would like to know if my husband could suddenly decide when I file for divorce and the Consent Order that he wants to claim on my property which is in my name etc. We haven't had contact for over two years and the separation was amicable. We have not discussed divorce, I realise I do not after five years separation need his consent to divorce him, however I am concerned the financial consent order will spur him on. I have thought about emailing him to get his feedback thus not shocking him when papers arrive at his door without warning, any advice or feedback welcome ?
